
Terms of Service
These Terms and Conditions of Service constitute the agreement ("Agreement") between ZENOFON LLC (" ZENOFON "we", "us"), and the user ("Customer" "you", or "user") of ZENOFON calling services and any related products or services ("Service").
The following terms must be agreed to before obtaining an account.
1 - By activating or using the ZenoFon service, Customer represents he/she is of legal age to enter into this agreement (usually 18) where you live and that you have used your own funds to do so
2 -As ZenoFon uses Ani Recognition to recognize the authorized user's caller ID and to bill their account, ZenoFon wil not be held liable for any failure of the Ani Recognition due to equipment failure.
3 -Customer agrees to maintain his/her telephone/cell phone service to deliver ZenoFon service. ZenoFon will not be liable for any malfunction in customer's phone service.
4 -ZenoFon service is currently available to make roaming calls from outside the United States only. Customer hereby agrees not to use this service as a third party business or as a reseller, and only to place calls for its own account.
5 -ZenoFon does not support 911 service or any other emergency service and Customer hereby understands ZenoFon cannot be relied to obtain emergency help. Local landline service must be used for emergency service.
6 -ZenoFon is not the same as landline telecommunications service. The service is subject to different regulatory treatments compared to pure telecommunications service. This treatment may limit or otherwise affect your rights before regulatory agencies.
7 -ZenoFon service is a pre-paid phone service exclusively. Customer hereby agrees that ZenoFon service that he/she will maintain a credit balance in his/her account. Customer is expected to replenish his/her credit balance by using a credit/debit card. Customers may opt to have its account set to "automatic replenish", at no change, to avoid repeated manual recharge. Customers accounts may be replenished online in Customer's "My Account" page on www.zenofon.com, by calling ZenoFon customer service at 1 (347) 560-9794 from the United States or via phone which entails customer selecting a provider by prompt after consulting the current rate schedule on-line.
8 -For billing purposes, fractional calls, both to the USA and those made internationally, will be rounded up to the next minute For example, a 6.4 minute call will be billed as a 7 minute call, as will a 6.5 minute call.
9 -There is no cancellation charge as of this writing. In the future ZenoFon may impose a cancellation charge with 7 days notice to all Customers by email.
10 -Customer hereby agrees that multiple call rates he/she has pre-selected may change without prior notice, due to maket conditions beyond the control of ZenoFon. Customer is advised to check the current rates on the www.zenofon.com website before placing calls.
11 -Rates may not include all taxes, surcharges or any other fees.
12 -In the event of a dropped call or a billing dispute of any nature, Customer hereby agrees to notify ZenoFon and ZenoFon will refund the charge at ZenoFon's sole discretion. All claims for credit must be made within 7 days of the call in question.
13 -There is no extra payphone access charge for non-toll free calls.
14 -ZenoFon is based on Voice Over Internet Protocol (VOIP), and as such, certain anomalies may occur beyond the control of ZenoFon. The quality of VOIP is not guaranteed by ZenoFon.
15 -ZenoFon believes that its affiliate commission plan is legal in the State of Delaware. However, in the event of any illegality by any competent jurisdiction, Customer hereby forgoes and absolves ZenoFon of any ommission.
16 -In the event of any legal action by ZenoFon to recover unbilled minutes, Customer hereby agrees to indemnify ZenoFon for any and all costs, including but limited to reasonable legal fees.
17 -ZenoFon is not responsible for any unauthorized third-party use of Customer's account.
18 -ZenoFon is not responsible for any charges from Customer's regular phone service provider in the event that Customer's regular phone service provider bills Customer for incoming calls in the course his/her using ZenoFon service.
19 -Customer acknowledges that if he/she breaches the Terms of Service, ZenoFon unconditionally reserves the right to close his/her account.
20 -ZenoFon has sole discretion regarding how much commission to pay out. Commission will be adjusted according to how long customer is with the company. ZenoFon reserves the right to withhold commissions for referrals of free (non-paying) customers. Commission can be paid out at anytime with 1 year of being earned at ZenoFon’s discretion. Commission can be revoked at anytime if ZenoFon suspects fraud. Customers can convert ZenoFon credit into cash 90 days after accumulation and into phone credit after 7 days. ZenoFon can change the commission structure at any time.
21 -Customer acknowledges that free credits for service may be revoked for any reason if ZenoFon sees fit to do so.
22 -Customer agrees not to use Zenofon service for calls originating in the USA or for any illegal purpose, including but not limited to prank phone calls or fraud.
23 -Customer acknowledges that ZenoFon will release his/her record of service to any public law enforcement agency upon request.
24 -Customer acknowledges that in the event that his regular phone service provider does not bill him/her for any call, he/she alone is responsible for alerting his/her regular phone service provider to this omission.
25 -Customer acknowledges that all credit card charges to his/her ZenoFon account are non-refundable, and can only be made towards ZenoFon service credit.
26 -Customer acknowledges that all ZenoFon service credit expires 6 months after it was first charged to his/her account. ZenoFon will begin charging a monthly fee for inactive accounts in the near future.
27 -Customer acknowledges that ZenoFon has the right to cancel service at any time.
28 -ZenoFon service is normally granted by referral only, Customer may only sign up once for a free account.
29 -Customer acknowledges if he/she is discovered to have signed up more than one free account, ZenoFon reserves the right to block Customer's service, charge Customer retroactively, and cancel Customer's account.
30 -Customer acknowledges that all listed rates are subject to change at any time. ZenoFon will attempt to contact Customer if rates to his/her destination change.
31 -All ZenoFon rates are listed both with and without taxes.
32 -Customer acknowledges that there are separate rates for calls that originate via Triggered Callback or by dialing into an access number.
33 -As of October 28, 2010, any new ZenoFon Customer will receive a $4 credit when he/she signs up for ZenoFon with a valid cel phone number and a .01 cent credit when signing up with a non-cel phone number. In the future, ZenoFon may change the amount of this offer at our sole discretion.
